I forward this email for my Polish frined and his company who are seeking for legal opinions， and we do appreciate if you can help us to answer thes questions or any advice which will be helpful! A Polish person is employed in a Polish company. The Polish company wants to send him on a delegation to China to stay there for about 330 days per year. The company has no office in China. The company has suppliers from China and want their employee to stay in China and visit the factories every time there is a delivery. This way they don’t have to buy a plane ticket from Poland to China for the employee every month. Apart from visits to the factories to inspect the products the Polish company has bought， before the products are sent to Poland， the employee is not doing any other work. Questions: 1. He is employed by a foreign company. He comes here on a 6 month business visa. He can do the business visit here in China， can he? Does the Polish employee sent to China need a work permit ? If yes，how to do it ? 2. What visa does the Polish employee need ? Business visa is OK ? or Working Visa ? 3. What Tax does the Polish employee in China has to pay ? Because of the agreement between China and Poland to avoid double tax， after 183 days the Polish company stops paying his taxes in Poland. After 183 days， what taxes does the employee staying in China has to pay ? And were to report ? 4. What about Social Security fees in China （I mean medical insurance， insurance in case of accident， etc） ? Does the employee have to pay these fees here? If yes， where should he repot ? 5. Who is responsible for paying taxes and the social security fees ? The company or the employee ? Where should the company or the employee report to ? 6. In Poland the company has the duty to pay retirement fund for the employee. Does the employee or the company have to pay retirement fund in China again ?
